Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs the use of the BrandInGang Fans platform (the "Service") operated by BrandInGang LLC ("Company," "we," "us," "our"). This AUP is incorporated into and forms part of our Terms of Service. All users—creators, subscribers, and visitors—must comply with this policy.
1. Purpose
This Acceptable Use Policy exists to:
- Protect the safety, dignity, and privacy of all users of the Service.
- Comply with applicable local, state, national, and international laws and regulations.
- Satisfy the content and compliance requirements of our payment processors, including Visa, Mastercard, and their acquiring banks.
- Comply with the acceptable use policies of our hosting and infrastructure providers.
- Maintain the Service's ability to operate and serve users without disruption.
- Prevent exploitation, abuse, and harm facilitated through the Service.
2. Absolutely Prohibited Content
The following content is strictly and absolutely prohibited on the Service. Posting, uploading, sharing, or distributing any of the following will result in immediate enforcement action:
2.1 Child Sexual Abuse Material (CSAM)
Any visual depiction, in any format (photo, video, illustration, computer-generated, AI-generated), of sexually explicit conduct involving a minor (any person under 18 years of age). This includes content that appears to depict a minor in a sexually suggestive manner, even if the actual age of the person depicted is unknown or claimed to be 18+. This also includes sexualized text content describing minors.
2.2 Non-Consensual Intimate Images
Intimate, sexual, or nude images or videos of any person shared without their explicit, informed consent ("revenge porn"). This includes content originally produced consensually but shared beyond the scope of the original consent, hidden camera/voyeur content, deepfakes or AI-generated intimate imagery of real persons without consent, and "creepshots."
2.3 Exploitation & Trafficking Content
Any content produced through coercion, force, fraud, trafficking, exploitation, or that facilitates human trafficking, forced labor, sexual servitude, or any form of modern slavery.
2.4 Bestiality/Zoophilia
Any content depicting sexual acts between humans and animals, or content that promotes, glorifies, or facilitates such acts.
2.5 Necrophilia
Any content depicting sexual acts involving corpses or deceased persons, or content that promotes or glorifies such acts.
2.6 Violence & Terrorism
Content that promotes, incites, glorifies, or facilitates real-world violence, acts of terrorism, violent extremism, mass casualty events, or recruitment for terrorist or extremist organizations. This includes manifestos, propaganda, and instructional content related to carrying out violent acts.
2.7 Human Trafficking
Any content that facilitates, promotes, or recruits for human trafficking, including sexual trafficking, labor trafficking, organ trafficking, or child exploitation.
2.8 Malware, Phishing & Scams
Distribution of malware, viruses, spyware, ransomware, or other malicious software. Phishing attempts, fraudulent schemes, advance-fee scams, or any deceptive practices designed to defraud users or steal credentials or financial information.
2.9 Illegal Content
Any content that violates applicable federal, state, or local law in the jurisdiction where it is produced or accessed, or that facilitates illegal activity.
2.10 Impersonation
Creating accounts or content that impersonates another person, brand, or entity with the intent to deceive. This includes using another person's photos, name, or likeness to create a false profile.
2.11 Doxxing & Privacy Violations
Sharing, threatening to share, or soliciting the private personal information of any person without their consent, including but not limited to: real name (where pseudonymity is expected), home address, phone number, email, workplace, school, financial information, medical information, or government ID numbers.
2.12 Harassment, Bullying & Threats
Content or conduct that constitutes targeted harassment, bullying, intimidation, or credible threats of violence against any individual or group. This includes coordinated harassment campaigns, repeated unwanted contact after being blocked, and threats of physical harm.
2.13 Hate Speech
Content that promotes hatred, incites violence, or dehumanizes individuals or groups based on protected characteristics, including: race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, veteran status, or immigration status.
2.14 Self-Harm & Suicide
Content that promotes, encourages, glorifies, or provides instructions for self-harm, suicide, eating disorders, or other forms of self-destructive behavior. This does not include content that discusses mental health recovery, suicide prevention, or raises awareness in a constructive, non-glorifying manner.
2.15 Illegal Drug Content
Content depicting or providing instructions for the manufacture, synthesis, or distribution of illegal controlled substances. Content facilitating the sale or purchase of illegal drugs.
2.16 Weapons Manufacturing
Content providing instructions for the manufacture of firearms, explosives, chemical weapons, biological weapons, or other weapons designed to cause mass harm. This includes 3D-printed firearm files and improvised weapon guides.
3. Restricted Content
The following content is permitted on the Service but subject to additional requirements and restrictions:
3.1 Sexually Explicit Content
- Permitted only from fully verified creators who have completed identity and age verification.
- Must be properly tagged as NSFW/adult content.
- All performers depicted must be at least 18 years of age with proper documentation per our 2257 compliance requirements.
- Must comply with all other provisions of this AUP (consent, no coercion, no prohibited categories above).
- Must not be visible to non-subscribers or on public-facing pages without age-gating.
3.2 Cannabis Content
- Content related to cannabis is permitted only where cannabis is legal in the creator's jurisdiction.
- Must not facilitate illegal sales or distribution.
- Must not target audiences in jurisdictions where cannabis remains illegal.
- Must comply with applicable advertising regulations.
3.3 Alcohol & Tobacco Promotion
- Content promoting alcohol or tobacco products must comply with all applicable advertising laws and regulations.
- Must not target or appeal to minors.
- Must include appropriate disclaimers where required by law.
4. Content Moderation Process
We employ a multi-layered approach to content moderation:
4.1 Automated Scanning
- All uploaded visual content is scanned using hash-matching technology against known CSAM databases (including the NCMEC hash database and other industry-standard databases).
- Matches or near-matches trigger immediate content quarantine, account suspension, and review by our Trust & Safety team.
- Additional automated detection tools may be employed for other categories of prohibited content.
4.2 User Reporting System
- All users can report content or accounts that violate this AUP using the reporting tools built into the Service.
- Reports are reviewed by our moderation team, typically within 24 hours for standard reports and immediately for reports involving CSAM or imminent safety threats.
- Reporters are protected from retaliation; we do not disclose reporter identities to the reported user.
4.3 Human Review Team
- Our Trust & Safety team conducts human review of flagged content, reported content, and content selected for random audit.
- Reviewers are trained on our policies and applicable legal requirements.
- Final enforcement decisions for account-level actions are made by senior team members.
4.4 Appeal Process
- Users may appeal content removal or account actions by submitting one (1) appeal within seven (7) calendar days of the enforcement action.
- Appeals are reviewed by a different team member than the one who made the original decision.
- Appeal decisions are final and will be communicated within ten (10) business days.
- Appeals are not available for content removed due to CSAM, trafficking, or other content that poses an immediate safety risk or involves criminal activity.
5. Enforcement
Violations of this AUP will result in the following graduated enforcement actions:
5.1 Standard Violations
- First Violation: Content removed. Written warning issued to the account holder via email and in-platform notification. The specific policy violation is identified.
- Second Violation: Content removed. Account suspended for seven (7) calendar days. Written notice of suspension. One more violation will result in permanent termination.
- Third Violation: Permanent ban from the Service. All content removed. Any pending balance is forfeited (held for 180 days to cover chargebacks, then disbursed minus deductions). The user is prohibited from creating new accounts.
5.2 Severe Violations
The following violations bypass the graduated enforcement process and result in immediate permanent action:
- CSAM: Immediate permanent ban. Content preserved and reported to NCMEC within 24 hours. Full cooperation with law enforcement. All account data retained for investigation.
- Human Trafficking/Exploitation: Immediate permanent ban. Reported to FBI and local law enforcement. All account data retained for investigation.
- Terrorism Content: Immediate permanent ban. Reported to FBI and relevant authorities.
- Imminent Threats of Violence: Immediate permanent ban. Reported to local law enforcement.
- Non-Consensual Intimate Images (Revenge Porn): Immediate content removal. Account terminated. May be reported to law enforcement depending on jurisdiction.
5.3 Additional Measures
We reserve the right to:
- Remove any content that violates this AUP without prior notice.
- Restrict account features (upload ability, messaging, withdrawal) during investigations.
- Withhold pending balances during investigations for up to 180 days.
- Cooperate with law enforcement investigations.
- Pursue legal action against users whose violations cause harm to the Company.
- Ban associated accounts, IP addresses, and payment methods to prevent ban evasion.
6. Reporting Violations
To report content or conduct that violates this AUP:
- In-Platform: Use the "Report" button available on all content and profiles.
- Email: abuse@brandingang.com
- CSAM/Child Safety: safety@brandingang.com (immediate priority)
- DMCA/Copyright: dmca@brandingang.com
When reporting, please include as much detail as possible: the URL of the content, a description of the violation, and any supporting evidence. Reports involving child safety are given the highest priority and will be addressed immediately.
7. Payment Processor Compliance
As a platform that facilitates transactions for adult content, we comply with the content requirements imposed by our payment processors, including but not limited to:
- Visa's BRAM Program: We comply with Visa's Brand Risk and Acquirer Monitoring requirements for adult content merchants, including pre-publication content review for high-risk categories, age verification of all performers, and consent documentation.
- Mastercard's Specialty Merchant Registration: We comply with Mastercard's requirements for specialty merchants, including content moderation, age verification, identity verification, and consent requirements as outlined in Mastercard's standards.
- Acquirer Requirements: We maintain compliance with our acquiring bank's requirements for acceptable content and business practices.
Content categories prohibited by payment processor rules are prohibited on our platform regardless of legality. These requirements may be more restrictive than applicable law and may change as payment processor policies evolve.
8. Hosting Provider Compliance
We comply with the acceptable use policies of our hosting and infrastructure providers. Content is routed and stored appropriately based on provider policies. We may implement additional content restrictions based on infrastructure provider requirements. Changes to hosting provider policies that affect content standards will be communicated to users with appropriate notice.
9. Updates to This Policy
We may update this Acceptable Use Policy from time to time to reflect changes in the law, payment processor requirements, or our operational practices. We will provide at least thirty (30) days' advance notice of material changes by posting the updated policy on the Service and notifying users via email. Your continued use of the Service after changes become effective constitutes your acceptance of the updated policy. If you do not agree to any changes, you must stop using the Service before the effective date.
